據公安部週一的數據，過去三年，全國共查處酒駕（drinking and driving）127.3萬起，辦理醉駕案件（cases of drunken driving）22.2萬件。
依據《中國刑事訴訟法》（Chinese Criminal Procedural Law），飲酒駕車是指車輛駕駛人員血液中的酒精含量大於或者等於20mg/100ml，小於80mg/100ml（more than 20 milligrams but less than 80 milligrams of alcohol per 100 milliliters of blood）的駕駛行爲。醉酒駕車是指車輛駕駛人員血液中的酒精含量大於或者等於80mg/100ml（80 milligrams or more of alcohol for every 100 milliliters of blood）的駕駛行爲。
依據2011年修訂的《道路交通安全法》（Criminal Law and Road Traffic Safety Law），酒後駕駛面臨着最高半年拘役（jail sentences）的處罰。
爲保護公共安全（protect public safety）、保證民用交通環境（guarantee a civil traffic environment），警方將加大對涉酒駕駛（alcohol-related driving）的處罰力度，始終保持對酒駕的“零容忍（zero tolerance）”。
